Ticket Dismissal

7 QUESTIONS

To dismiss a Texas traffic ticket using a defensive driving course, follow these five steps:

  • Contact your court on or before your appearance date and request permission to take a TDLR-approved defensive driving course
  • Plead guilty or no contest to the violation — this is required by Texas law
  • Enroll in our TDLR-approved course (Provider CP206) for just $25
  • Complete the 6-hour online course before the court's deadline — typically 90 days
  • Submit your certificate of completion and a Type 3A certified driving record to the court

Once the court reviews your documents, your ticket is dismissed and no points are added to your Texas driving record.

See the full step-by-step process →

Most Texas courts give you 90 days from your plea date to complete the defensive driving course and submit your documents. However, this deadline varies by court — always confirm the specific deadline with your court when you request permission.

Do not wait. Enroll immediately after getting court permission. You also need time to order your Type 3A driving record from Texas DPS, which can take a few days to process.

If you miss the court's deadline, you will likely forfeit your right to use defensive driving for this ticket dismissal.

You may use a TDLR-approved defensive driving course for ticket dismissal once every 12 months. The 12-month period is measured from the date you completed your most recent course — not from when you received the current ticket.

Example: If you completed a defensive driving course on March 15, 2024, you cannot use another course for ticket dismissal until March 15, 2025 — regardless of when you got the new ticket.

There is no limit to completing the course for insurance discount purposes — that can be done at any time.

Yes. When your ticket is dismissed through a TDLR-approved defensive driving course in Texas, no points are added to your Texas driving record for that violation.

  • Your auto insurance company cannot use the dismissed violation to raise your premium
  • The points that would have been added to your Texas Driver Responsibility Program record are avoided

Note: Defensive driving does not remove points from violations already on your record — it only prevents the current violation from being recorded.

Yes — in most cases. You can dismiss a Texas speeding ticket using defensive driving as long as you were traveling less than 25 mph over the posted speed limit.

  • Speeding 1–24 mph over the limit → eligible for defensive driving dismissal
  • Speeding 25+ mph over the limit → NOT eligible

Check your full eligibility here.

Pleading no contest (nolo contendere) means you accept the court's judgment without formally admitting guilt. For Texas defensive driving ticket dismissal, a no contest plea is treated the same as a guilty plea.

Important: Pleading no contest does NOT automatically dismiss your ticket. You still need to complete the course and submit your certificate and Type 3A driving record to the court before the deadline.
  • Paying the fine: Violation recorded as conviction. Points may be added. Insurance premium can increase. Fine often $150–$500+.
  • Taking defensive driving ($25): Ticket dismissed. No conviction recorded. No points added. Insurance cannot raise your rate.

Eligibility Rules

4 QUESTIONS

No. Texas law does not permit CDL holders to use defensive driving for ticket dismissal of violations that occurred while operating a commercial vehicle. Contact your court directly for available options.

You must meet ALL of these requirements:

  • Plead guilty or no contest to the violation
  • Have not completed a defensive driving course for dismissal in the past 12 months

  • Violation did not occur in a construction zone with workers present
  • You did not illegally pass a school bus
  • The court grants you permission
  • You requested permission on or before your court appearance date

No. Violations in a construction zone with workers present are not eligible for ticket dismissal through defensive driving. If there were no workers present, check with your specific court.

Yes. You must hold a valid Texas driver's license (not expired, not suspended) at the time you enroll and complete the course. If your license is suspended or expired, contact your court directly before enrolling.

Texas Driving Record

3 QUESTIONS

A Type 3A certified driving record is an official document from the Texas DPS showing your complete Texas driving history. Most courts require it alongside your course certificate for ticket dismissal. It confirms your name, license number, driving history, and that you haven't used defensive driving in the past 12 months.

How to get your Type 3A driving record →

Order your Type 3A certified driving record online through the Texas DPS website. It typically takes 2–5 business days. Order as soon as you get court permission — do not wait until you finish the course.

Complete guide: How to get your Texas driving record →

Most courts require it, but requirements vary. Always confirm the exact requirements with your specific court when you request permission. Ask: "What documents do I need to submit for ticket dismissal through defensive driving?"
